By entering any of our photo submission contests (the “The Ways Of The Dog Contest(s)”) and accepting the terms herein, you agree to be bound by the following rules (“Official Rules”), which constitute a binding agreement between you, on one hand, and The Ways Of The Dog on the other. The Ways Of The Dog and any website companies hosting and promoting the Contest, their respective parent companies, affiliates, subsidiaries, advertising and promotion agencies, and all of their agents, officers, directors, shareholders, employees, and agents are referred to as the “Contest Entities.” These Official Rules apply only to the The Ways Of The Dog Contests and not to any other sweepstakes or contest sponsored by The Ways Of The Dog unless otherwise stated in the entry procedures.
Sponsor: The Ways Of The Dog, Brooklyn NY 11211, (the “Sponsor”), unless otherwise stated in the entry procedures. This contest and any other The Ways Of The Dog Contest is in no way sponsored, endorsed or administered by, or associated with, Facebook, Twitter and/or Instagram.

How to Enter: The entry procedures for each contest are announced on Instagram and here on our website. Unless otherwise stated in the entry procedures, the winners will be selected at random from among all eligible entries received.
The Ways Of The Dog will not verify receipt of entries. Incomplete entries are void. The Ways Of The Dog is not responsible for entries that are lost, late, misdirected, incomplete, incomprehensible, illegible, undeliverable or delayed. Any use of robotic, automatic, programmed or the like entry methods will void all such entries by such methods. Facebook/Instagram entries will be deemed to have been submitted by the authorized account holder of the social media account at the time of the entry

Eligibility: Our contests are generally open to legal residents of the United States at least 18 years of age as of Date referenced below as the start date for the Contest (“Entrants”). And who does not reside in an area where such contests are void by law. Employees (or their immediate families) of The Ways Of The Dog or any subsidiary are not eligible to win our contests or giveaways. By entering this Contest, each entrant agrees to release and hold harmless Contest Entities from any injury, loss, death, damage, action, claim, demand or other liability that may occur from entrant’s participation in this Contest or from the acceptance, use or misuse of any prize awarded, or attendance at any event.  The Ways Of The Dog reserves the right to verify eligibility qualifications of any winner. U.S. law governs all The Ways Of The Dog Contests.

Prize(s): All prize information including prize value is listed with each contest announcement. In each contest or giveaway, we reserve the right to substitute a prize of equal or greater value in the event that the original promised prize becomes unavailable. Some prizes may be awarded via gift certificate. The prizes have no cash value and/or a cash value less than $5,000. Prizes may not be exchanged for cash or other substitution except at The Ways Of The Dog sole discretion. Winners have 30 days to claim prize once notified, if winners do not claim prize within 30 days the prize becomes null and void

General Release: By participating in any The Ways Of The Dog Contest, submitting an Entry and/or winning a prize you hereby release and discharge, The Ways Of The Dog, Facebook, Inc., Pinterest, Twitter, any participating sponsors, and any of their respective parent companies, subsidiaries, affiliates, directors, officers, professional advisors, employees and agencies (collectively, the “Released Parties”) from any and all liability with respect to the promotion/contest or the acceptance, possession or use of any prize, including without limitation (1) any condition caused by events beyond The Ways Of The Dog control that may cause the promotion/contest to be disrupted or corrupted; (2) any injuries, losses, or damages (compensatory, direct, incidental, consequential or otherwise) of any kind arising in connection with or as a result of the prize, or acceptance, possession, or use of the prize, or from participation in the specific The Ways Of The Dog Contest;  (3) any printing or typographical errors in any materials associated with the promotion/contest; (3) cancellations, postponements, or delays; and (4) Acts of God, war, terrorism, government regulation, disaster, fire, strikes, civil disorder, or other similar causes beyond the control of The Ways Of The Dog, their affiliated, parent, and subsidiary companies, advertising and promotional agencies and their immediate assigns, making it inadvisable, illegal, impossible, or impractical to continue the The Ways Of The Dog Contest or to perform under these Official Rules. The Ways Of The Dog’s decisions in all respects relative to the promotion/contest are final. The Ways Of The Dog makes no warranty, guarantee, or representation of any kind concerning any prize. The Ways Of The Dog reserves the right to modify, suspend, terminate or cancel the Contest, as appropriate, due to any other reason beyond the control of The Ways Of The Dog.

Content Restrictions: You may not submit or post anything that is offensive or violates any third party’s rights. For example, your Entry must not contain or reference any of the following:

Material that violates or infringes another’s rights, including but not limited to privacy, publicity or intellectual property rights; (we have obtained the permission of all artists pinned on our board, you may re-pin any on our boards or upload your own)
Nudity or lewd, vulgar, indecent or obscene images (as determined by Sponsor’s sole discretion);
Material that is copyrighted, trademarked, protected by trade secrets or otherwise subject to a third party’s proprietary rights, including privacy and publicity rights, unless you are the owner of such rights or have permission from their rightful owner to post the material;
Depiction of defamatory statements (including but not limited to words or symbols that are widely considered offensive to individuals of a certain race, ethnicity, religion, sexual orientation or socioeconomic group);
Third-party trademarks, names or logos; or
Material that is unlawful, in violation of or contrary to the laws or regulations in any country, state or province where the Contest Entry is created.

Sponsor may, in its sole discretion, disqualify any Entry that does not comply with these Official Rules or that Sponsor otherwise deems to be inappropriate in its sole discretion. In the event of disqualification, the Entry will not be judged or considered for a prize.

Winners: The winner does not have to be present at the time of the announcement unless otherwise noted. Winners automatically grant the use of their name and likeness in the promotion of this and other The Ways Of The Dog Contests. Winners are responsible for applicable state or federal taxes as well as shipping and handling. There may be only one prize winner per household every 30 days. Winners lists may be obtained by emailing The Ways Of The Dog at info@thewaysofthedog.com.

All The Ways Of The Dog contests and giveaways are subject to all federal, state, provincial, and local laws and void where prohibited. It is your responsibility to refrain from entry if our contests or giveaways are illegal in your jurisdiction. If you are declared a winner, but contests and giveaways like these are illegal in your jurisdiction, your prize will be forfeited and given to a runner-up.
No Third-Party Infringement: All photos, images, and entries in its entirety must be original material captured by the Entrant. By entering the Contest, entrant represents, acknowledges and warrants that the submitted image is an original work by contestant and does not infringe on the copyrights, trademarks, moral rights, rights of privacy/publicity or intellectual property rights of any person or entity and that no other party has any right, title, claim or interest in the photograph.

License: By entering a The Ways Of The Dog Contest, the photographer will retain the rights of each photograph. However, winning and/or selected photographers shall be expected to grant The Ways Of The Dog a non-exclusive, worldwide, irrevocable, royalty-free license to reproduce, reformat, adapt, creative derivative works, distribute, transmit, and display the photograph(s) photographer submits to The Ways Of The Dog in and/or through any and all medium or media, now known or hereinafter developed or discovered, in connection with the The Ways Of The Dog Contest and for no other use except with photographer’s additional written consent, which shall not be unreasonably withheld. The Ways Of The Dog will not be required to pay any additional consideration with such use. All physical or digital copies of photos, images, and entries (“Entry”) submitted as part of the The Ways Of The Dog Contests will not be returned. The Ways Of The Dog may collect metadata of an Entry. You further acknowledge and agree that Entries may be shared and reposted on various forms of social media by other contestants as a part of the The Ways Of The Dog Contests, without recourse. Contest Entities assume no responsibility for any hardware or software malfunctions, connections, availability, transmissions, or unauthorized human intervention.The Ways Of The Dog reserves the right to modify, suspend, or terminate the The Ways Of The Dog Contest in whole in whole in part by giving such notice, in any form and manner deemed appropriate by The Ways Of The Dog. Should the promotion be modified, suspended, or terminated as aforesaid, the prizes may nevertheless be awarded from eligible entries previously received and in accordance with these Official Rules. Additionally, by entering, each entrant grants to The Ways Of The Dog the unrestricted right to use all statements made in connection with the The Ways Of The Dog Contests, and pictures or likenesses of Entrants, or choose not to do so, at their sole discretion.

IN NO EVENT WILL ANY OF THE CONTEST ENTITIES BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF YOUR PARTICIPATION IN THE CONTEST, ANY PRIZES WON, YOUR ACCESS TO OR USE OF ANY OF THE WAYS OF THE DOG’S WEBSITE OR THE FACEBOOK WEBSITE (INCLUDING THE WAYS OF THE DOG'S FACEBOOK OR INSTAGRAM PAGE) OR THE THIRD-PARTY APPLICATION, OR THE ACCESSING, UPLOADING, DOWNLOADING AND/OR PRINTING OF ANY MATERIAL AVAILABLE ON SAID SITE. WITHOUT LIMITING THE FOREGOING, EVERYTHING ON THESE WEBSITES IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, or the rights and obligations of you or The Ways Of The Dog in connection with the The Ways Of The Dog Contests, shall be governed by and construed in accordance with, the laws of the State of New York, without regard to the conflict of laws principles.I understand by entering The Ways Of The Dog's contest, I will receive marketing emails from The Ways Of The Dog which I can unsubscribe to at any time.The personal information collected from you in the course of any The Ways Of The Dog Contest will be used by The Ways Of The Dog for the purposes of administering the contest, including contacting selected Entrants, and in accordance with our privacy policy.
